EXECUTIVE ORDER NO. 429

PROVIDING FOR THE REORGANIZATION OF ADMINISTRATIVE REGION VI TO INCLUDE THE PROVINCE OF PALAWAN AND PUERTO PRINCESA CITY

WHEREAS, the 1987 Constitution states that the President shall exercise general supervision over local governments;

WHEREAS, there is an urgent need to reorganize administrative Region VI to include the Province of Palawan and Puerto Princesa City to guarantee the effective delivery of field and public services of government agencies and accelerate social and economic development in the same;

NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order:

Section 1. Region VI is hereby reorganized to include the Province of Palawan and Puerto Princesa City;

Section 2. The Department of Interior and Local Government is hereby directed to supervise the transfer of the Province of Palawan and Puerto Princesa City from Region IV to Region VI;

Section 3. All issuances, orders, ordinances, rules, regulations and issuances or parts thereof which are inconsistent with this Executive Order are hereby repealed or modified accordingly;

Section 4. This Executive Order shall take effect immediately following the completion of its publication in a newspaper of general circulation.

MODIFYING EXECUTIVE ORDER NO. 429, SERIES OF 1990, ENTITLED “PROVIDING FOR THE REORGANIZATION OF THE ADMINISTRATIVE REGIONS IN MINDANAO, AND FOR OTHER PURPOSES”

Pursuant to the powers vested in me by law, I, CORAZON C. AQUINO, President of the Philippines, do hereby order:

SECTION 1. Section 2 of Executive Order No. 429 dated 12 October 1990 is hereby amended to read as follows:
 

“SEC. 2. REGION X, to be known as NORTHERN MINDANAO, shall include the following provinces and cities:

Provinces:

       Agusan del Norte         Camiguin
       Agusan del Sur            Bukidnon
       Misamis Oriental         Surigao del Norte
 

          Cities:

           Cagayan de Oro
           Gingoog
           Butuan
           Surigao
 

The City of Cagayan de Oro shall serve as the regional center.”
 

SEC. 2. This Executive Order shall take effect immediately.

DONE in the City of Manila, this 7th day of December, in the year of Our Lord, nineteen hundred and ninety.

MEMORANDUM CIRCULAR NO. 75

DIRECTING THE TRANSFER OF REGIONAL OFFICE OF ALL DEPARTMENT AND AGENCIES FROM ZAMBOANGA CITY TO PAGADIAN CITY PURSUANT TO EXECUTIVE ORDER NO. 429 SERIES OF 1990

WHEREAS, Executive Order No. 429, series of 1990 reorganized the administrative regions in Mindanao;

WHEREAS, Section 1 of EO 429 reorganized Region IX, and designated the City of Pagadian as the regional center and the City of Zamboanga as the commercial and industrial center.

NOW, THEREFORE, I, EDUARDO R. ERMITA, Executive Secretary, by authority of Her Excellency GLORIA MACAPAGAL – ARROYO, do hereby order:

SECTION 1. Except as herein provided, all regional offices of departments and agencies are hereby directed to transfer from Zamboanga City to Pagadian City as soon as practicable.

SECTION 2. The Department of Trade and Industry, Department of Labor and Employment and Employment and Department of Tourism shall remain in Zamboanga city, the commercial and industrial center. However, they shall establish a presence in Pagadian City.

SECTION 3. This Memorandum Circular shall take effect immediately.

Done in the City of Manila this 12^th day of November in the year of our Lord, Two Thousand and Four.

Just the Facts, M'am!

Zamboangueños and the World must understand the facts about Arroyo's evil quest to squelch Zamboanga City's constituents because of their political voice.

Fact #1	According to the Philippine Senate, 13th Congress of the Republic of The Philippines, the EO #429 was issued by President Cory Aquino on Oct. 12, 1990 - very symbolic because it's Zamboanga's Fiesta Pilar day - and was part of the A.R.M.M.!
Fact #2	According to the Philippine Senate, 13th Congress of the Republic of The Philippines, the EO #429 issued by President Aquino was lawfully repealed by President Ramos on April 12, 1996 with his EO #325, under Sec. 19!  Therefore, Cory's EO#429 no longer exists, and even the Philippine Supreme Court's legal records doesn't have reference to her  EO#429, circa 1990!  No wonder we can't find the damn thing!!!  Legally, it's no longer legal!  So, Arroyo can't use it as her excuse to punish Zamboanga!  That's your own evil  decision, M'am!  Own it!
		Executive Order No. 325 FACTS: SEC. 17. Implementing Rules. The NEDA Board is hereby directed to prepare and adopt detailed guidelines to implement the specific provisions of this Executive Order.  (NEDA = National Economic and Development Authority, as mandated by the Philippine Constitution, is the country’s independent economic development and planning agency) SEC. 19. Repealing Clause. All previous issuances inconsistent with the provisions of this Executive Order are hereby repealed or modified accordingly.  (LEGAL: Means, President Ramos overrode President Aquino's EO 429 and shut down Pagadian City!)
Fact #3	According to the Philippine Senate, 13th Congress of the Republic of The Philippines, NEDA adopted the Rules & Regulations to implement EO #325 on August 20, 1996, and designated Zamboanga City as its Regional Center for Region IX!  This is how it all came to be for Zamboanga City, before Arroyo&Co....
Fact #4	Then, enter Arroyo & Co., and all hell broke loose!  The devil then set its sight on Z.C.!  Arroyo lost big time in Z.C. but won hands down in P.C.  Payback's a bitch, ain't it?  Is it legal?  Where does the P.I. rank in the transparency meter?  The military's still in town...  What's next?  Hang 10, dude!... dudette? The fact is President Arroyo overrode President Ramos' lawful EO#325 with  memorandum circular no. 75 on November 12. 2004..  Just like Nike... maybe it was dictated.  Dictate... Facts #5	The Philippines is a Republic, based on the hallowed principles of democracy and freedom of its people from a dictatorship.   The Senate of The Philippines is the highest legislative body of the country that represents the entire country’s constituency and is not regionalized, making their voice the voice of The Philippine citizenry in general.   Arroyo & Co. intentionally refused to abide by the Philippine Senate’s adopted resolution of January 12, 2006 urging Arroyo to stay, or stop, her order to transfer the Regional Offices of Region IX from its present location in Zamboanga City to Pagadian City in Zamboanga del Sur province, in accordance to her executive Memorandum Circular No. 75, authorized by herself on November 12, 2004.   Arroyo’s executive Memorandum Circular No. 75 (MC#75) ordering the transfer of the Regional Offices of Region IX from its present location in Zamboanga City to Pagadian City in Zamboanga del Sur province, effectively repealed President Ramos’ Executive Order No. 325, signed into law April 12, 1996, which Ramos used to repeal President Aquino’s EO #429 issued on Oct. 12, 1990 as part of the ARMM, wherein she ordered the transfer of the regional center in Region IX from Zamboanga City to Pagadian City.   After 17 years of Zamboanga City remaining the regional center of Region IX, post repealing of EO#429, Arroyo & Co. is using the repealed EO#429 as an excuse to implement their intent to have the regional center in Region IX transferred from Zamboanga City to Pagadian City.  There is no legal or economical precedence to validate Arroyo & Co.'s evil desire to punish Zamboanga City.  Zamboanga City area has been the #1 GDP area in the entire country, outpacing any areas of the country in business growth and steadfastness!  This fact does not escape NEDA nor the Regional Center Directors, and most importantly Zamboanga City's surrounding neighbors like Basilan, Zamboanga del Norte, and Zamboanga Sibugay!  These noted neighboring Provinces are strongly opposed to the regional center transfer from Zamboanga City!  Millions of these Mindanao-area citizens will be negatively affected.  Does she care at all?   Arroyo’s executive Memorandum Circular No. 75 effectively repealed the constitutional mandate of the National Economic and Development Authority (NEDA), which is the country’s independent economic development and planning agency as mandated by the Philippine Constitution, in their designating Zamboanga City as the Regional Center for Region IX, when they adopted the Rules & Regulations to implement President Ramos’ EO #325 on August 20, 1996.  NEDA has been quite satisfied with their decision on Zamboanga City for the past 11 years, but now Arroyo’s dictate in MC#75 is superseding their constitutional authority.  Is this a constitutional outrage or what?   Arroyo & Co. has not given the country its main reason why they are proceeding with the regional center transfer from Zamboanga City, as their said excuse in MC#75 has no legal standing because EO#429 has been repealed by EO#325!!!  Why are you doing this, M'am?  The whole country wants to know!!!   The Philippine Senate has warned that Arroyo’s uncalled for MC#75 will cost the impoverished country over 2 billion pesos to implement, representing a gross waste and abuse of taxpayers’ money and executive privilege!!!  And for what purpose or to what avail?  Payback?  Kickback?  Who will have to pay the burden of your dictate, M'am?
